Getting suspicious buyer messages?

Test purchases ahead of a formal notice are a documented practice — these are the traits worth watching for in any pre-purchase inquiry:

  • Names a specific listed chemical (e.g. DEHP, lead, cadmium) and connects it correctly to your product's material
  • Asks for documents — SDS/MSDS sheets, factory material declarations, or lab test reports
  • Uses supply-chain vocabulary: HS customs codes, import records, country of manufacture
  • Sympathy framing ("I have a baby at home") that encourages a fast, unguarded reply
  • Two-step escalation: a soft opening question, then a technical follow-up once you engage

Frequently asked questions

What is a Prop 65 "60-day notice" and who can send one?
A 60-day notice is the formal document that must be served on a business and on public enforcers before a private Proposition 65 lawsuit can be filed. Besides the California Attorney General, any private individual or law firm ("private enforcer") can serve one. Every notice is filed in the California Attorney General's public database — the same database this tool mirrors.
A buyer is asking me for SDS sheets, test reports, and about specific chemicals — is that normal?
Ordinary consumer inquiries rarely name safety data sheets (SDS), HS customs codes, or specific listed chemicals. In publicly reported seller cases, messages with these traits have sometimes preceded formal notices. This tool cannot determine any sender's intent — it only shows public filing records, which you can search above to see activity in your product category.
Does adding a Prop 65 warning "just in case" settle the question?
Not necessarily. Prop 65 warning obligations turn on whether a product actually causes exposure to a listed chemical, which is normally a question answered by test data. California's regulator (OEHHA) has also publicly discouraged unsupported "over-warning". Whether a warning is required, and how it should be worded, is a question to resolve with test results and professional advice.
How should I reply to a message like this?
We can't advise on individual situations. What can be said factually: marketplace threads are written records; statements about chemical composition are factual claims that most sellers have no batch-level test data to support either way; marketplaces publish their own response-time rules; and questions about legal exposure are the territory of a licensed attorney.
How do I find out whether my brand or company has been named in a notice?
Type your brand, company, or shop name into the search box at the top of this page to check filed public notices. You can also create a free watchlist below — we'll email you when a new filing appears to reference a name you've registered.
Can I stop professional filers from targeting me?
No — private enforcement with a penalty share is built into Proposition 65 by design, so professional filers will exist as long as the law does. What a seller controls is how attractive a target they are. Four things recur in publicly reported outcomes: (1) have supplier material declarations and accredited-lab test reports on file before anyone asks; (2) warn correctly where a warning is required (a compliant short-form warning removes the core theory of a claim); (3) never speculate about product composition in writing — composition questions are answered by test data; (4) watch the public filing record with a free watchlist so you learn of a filing while the notice window is open. This is general information, not legal advice; settlement and defense questions are the territory of a licensed attorney.
Why would I track a specific noticing party ("repeat filer")?
The public filing record shows that many noticing parties file in campaigns: dozens or hundreds of notices over a few months, concentrated on the same chemical and product category — first one product that tested positive, then similar products across the marketplace. A new filing by a party you watch, against a product similar to yours, is therefore a publicly visible early signal that your category is in an active filing wave. Seeing that signal before a notice arrives leaves time to request supplier declarations, arrange testing, or review labelling — instead of first learning about it after a formal notice is served. The watchlist only relays public filing records; it is not legal advice.

Global Agentic Holdings Limited (globalEPR.ai) is not a law firm and does not provide legal advice, compliance determinations, or attorney referrals. All notice data originates from public California Attorney General and OEHHA records; see original filings for authoritative detail.
